Applications SW/16/500694 (KCC/SW/0002/2016) and SW/16/500698 (KCC/SW/0003/2016) - (i) Extension of period of time allowed for waste disposal by 10 years, allowing operations to continue until 31 December 2025, plus an additional 12 months for final restoration and the establishment of afteruses; and (ii) storage of clay for the duration of workings on Land to the north at Norwood Quarry and Landfill Site, Lower Road, Minster-on-Sea; FCC Environment (UK) Ltd

Minutes:

RESOLVED that:-

 

(a)          permission be granted to the extension ofthe periodoftime allowed for waste disposal by10 years,allowingoperations tocontinueuntil 31December2025, plusan additional12 monthsfor finalrestorationand theestablishmentof afterusessubject to:-

 

(i)      conditions, including conditions covering theimportation,treatmentand landfillofboilerash, airpollution controlresidues(APCRs)and incinerator bottomash (IBA) ceasing by31 December2025 andrestorationofthesitebeingcompleted by31 December 2026; therecommendationswithintheupdatedEcologicalAssessment beingimplemented;and there-impositionofconditionspreviouslyimposedon Permission SW/14/501576(updatedand amendedas necessary)including thedevelopmentbeingcarriedoutinaccordancewiththe approveddetails;  no extraction taking place below35m AOD;    onlyboilerash,APCRsandIBAfromtheAllingtonEfW Facilitybeingreceivedonsite; hours  of  operation  being  restricted  to  landfilling between 0700 and1800 onMondaystoFridaysand 0700to1300 on Saturdays, clayextraction between 0730 and 1800on MondaystoFridaysand between 0730and1300on Saturdays, storage mounds between 0800and1800hours on Mondays toFridaysand between 0800 and1300 hourson Saturdays,withno operationson Sundaysor BankHolidays; no more than acombinedtotal of 200 HGVmovements(100 in / 100out)perday; measurestopreventmudand debrison the publichighway; boiler  ash  and  APCRs  only  entering  the  site  in  HGVs (tankers)  dedicated  to  transporting  such  wastes  with all loaded,openbackedvehiclesbeingsheeted; themaintenanceofvisibilitysplaysat thesiteentrance; noisecontrolsfornormal andtemporaryoperations; measurestocontrol dust; aprogrammeofarchaeologicalwork; soil storageand handling; thesubmissionofannual progressreports;and landscaping,restorationand aftercarebeingimplemented as approved; and

 

(ii)   Informativesadvisingtheapplicantoftheneedtomaintainpublicaccess to thepublicrightofway;and to update the ecologicalassessmentspriorto commencing finalrestoration in order toensure that protectedspeciescontinueto be safeguarded; and

 

(b)    permission be granted forthestorageofclayforthedurationofworkingssubject to:- 

 

(i)          conditions, including conditions covering amongst other matters the  storage  of  clay  ceasing  and  the  site  being  restored  to agricultureon orbefore31 December2026;       the developmentbeingcarriedout andcompletedinaccordance with thedetailscontainedwithin theapplication; noexternal lightingwithoutpriorapproval;  hoursofoperationfortheclaystorageoperationsbeing0800 to 1700on MondaystoFridayswithno operationson Saturdays, Sundaysand BankHolidays; the onlyaccess tothesitebeingthroughthemainquarryand landfill site; noisefromnormaloperationson sitebeingrestrictedtothespecific limitspreviouslypermitted; noisefromtemporaryoperationsnot exceeding70dBLAeq,1hr  atany noisesensitiveproperty(andonlyforup to8 weeksinany 12 monthperiod);  themitigationmeasuresset outwithinthedust assessmentbeing implemented; the recommendationswithintheupdatedEcologicalAssessment beingcompliedwith; thearchaeologicalrequirementssetout withintheapplicationbeing compliedwith; soil storageand handling requirements; treeprotectionmeasures; the sitebeing fenced; and thesubmissionoffinalrestorationand aftercareschemesforprior approval;and

 

 (ii)      an Informativeadvisingtheapplicantoftheneed tomaintainpublicaccess to thepublicrightofway.
