Minutes:
(1) The Head of Planning Applications Group reported correspondence from Mr Paul Bartlett which had previously been circulated to the Committee. This correspondence included the suggestion for a specific condition requiring the use of a sprinkler and for the “nearest noise sensitive receptor” condition to be strengthened to take account of possible new houses to the south of the application site. The Head of Planning Applications Group advised that it would not be appropriate to require the applicants to fulfil a condition in respect of a future development that might or might not arise and also that the proposed conditions included a requirement the development to be carried out in accordance with the approved details and drawings set out in the application. This included the use of a sprinkler.
(2) RESOLVED that permission be granted to the application subject to conditions, including conditions covering implementationwithin3 yearsof the dateof the permission; the developmentbeingcarriedout inaccordancewiththeapproveddetailsand drawingsset out intheapplication; noise mitigation measures being put in place priortothecommencementofthe High Output Operating Base (HOOB), includingtheerectionofthe variousbuildingsand structures associatedwiththedevelopment,and theprovision and maintenance ofa 6mhighbund, noisebarrieror combinationofbothalongtheeastern andsouthernperimeters of the site, togetherwiththeconstruction and maintenanceofa 5mhighnoisebarrieraroundthe perimeterofthe railsidings,as shownon Figure5 oftheRPSNoiseAssessment ReportdatedOctober 2016; the noiseratinglevelcalculatedand measuredinlinewithBS4142:2014at the nearestnoisesensitivereceptorsbeing atorbelow42 dBLar forany15min periodbetween5am.and 7am; thenoiseratinglevelcalculatedand measured in linewithBS4142:2014at thenearestnoise sensitivereceptorsbeing ator below52 dB Larfor any1hr periodbetween7am.and 11pm; noisemonitoringbeing carried out, with the results being submitted to the County Planning Authority within one month, uponthecommencement of theHOOBoperations at the nearest noise sensitive receptors in order to demonstrate whetherthenoiselimitsspecifiedarebeingmet; operationsimmediately ceasing intheeventthatthelevelsmeasured areabovethose specified,untilsuch timesas additional noise mitigation measuresare putin place. Furthernoisemonitoringbeing carried outupon the re- commencementoftheHOOBoperations, with the results being submitted to the County PlanningAuthoritywithinone monthin order to enable an assessment to be made as to whether further additional noise mitigationmeasuresarerequiredinorder to complywith thenoiselimitsset; the submissionof a remediationstrategyintheeventofthediscoveryof anyground contaminationduringsiteconstruction; no infiltrationofsurfacewaterinto the ground,exceptwhereitcan bedemonstrated that thereisno unacceptable risk to groundwater; all foul drainagebeingcontainedwithina sealedcesspit; the submissionand approvalofa detailedsurfacewaterdrainageschemepriorto commencement of the development. nooccupationof anybuildings taking place until after the implementationof theapprovedsurfacewater drainagescheme; the submissionand approvalof detaileddesignplansfortheproposeddiversionof PublicRightofWayAE350; retentionoftheexistingPublicRightof Way AE350on itscurrentrouteuntil such timesas theDiversionOrder securingitdiversionhas beencertified; and noobstructionofeither thecurrent Public Right ofWayAE350or itsdivertedroute throughout the durationoftheHOOBoperations.
