Proposal SH/18/39 (KCC/SH/0344/2017) - Two storey extension to be constructed in two phases, internal alterations and the provision of a new parking/drop-off area accessed from Jubilee Close at Palmarsh Primary School, St George's Place, Hythe; Gen 2 Property

Minutes:

(1)       The Transport and Development Manager informed the Committee that, further to the comments in the report, funding had been provided for a potential pedestrian crossing on the A259 between St George’s Place and Jubilee Close.   Its provision would be subject to the outcome of the consultation process and the views of the local Joint Transportation Board. 

 

(2)       RESOLVED that:-

 

(a)          permission be granted to the proposal subject to conditions including conditionscovering the standardtime limit; the development being carried outin accordance with the permitteddetails;  thedevelopmentbeing carriedoutusingtheexternalmaterialsandcolourfinishesas specified within the planningapplication documentsunlessotherwise agreed;   landscapingbeingprovidedon siteinaccordancewiththeapplicationdetailsinthe first available plantingseasonfollowingcompletionofphase 1thedevelopment;  the submission of a BiodiversityMethod Statement regardingbatsandreptiles; the submission of detailsofecological enhancementson theschoolsite; no treeremoval during the bird breeding season; the submissionofan updatedTravelPlanpriorto occupation,and its ongoing monitoring andreview thereafter; the provision(priortooccupation)andretentionofcarparking,cycleparking,drop off areaand circulatoryroutes; the applicantsundertaking their bestendeavourstoimplement the parkingrestrictionsdetailed in the accompanyingTransportStatementvia the statutoryTrafficRegulation Orderprocess; the developmentbeingundertakeninaccordancewiththecontentoftheFloodRisk Assessment, includingadherencetothemitigation measureslisted within it; the submission of a detailed Sustainable SurfaceWaterDrainageScheme; and the  submission  of  details  regarding  the  maintenance  and  management  of  the Sustainable Surface Water Drainage Scheme; the  submission  of  a  verification  report  regarding  the  Sustainable  SurfaceWater DrainageScheme; seagulldeterrent beinginstalledon the roofwithin1 month of the completionofphase 1 of thebuildingworks; hoursofworkingduringconstructionbeingrestrictedtobetween0800and1800 on MondaystoFridaysandbetweenthehoursof0900and1300on Saturdays,withno operationson Sundaysand BankHolidays; and the submission for approval of a construction managementstrategy,includingaccess,lorry routing,parkingand circulationwithinthesiteforthe contractor’sandothervehiclesrelatedtoconstruction activities,detailsofhow the siteaccessis to bemanaged to avoidpeakschool times,andmeasurestopreventmudanddebrisbeing takenontothepublichighway; and

 

(b)          the applicants be advised by Informative that:-

 

(i)           they areadvisedtoregisterwithKentCountyCouncil'sTravel PlanManagementsystemJambustersin respect oftherequirementtoprepareandsubmita (revised/amended)School TravelPlan;

 

(ii)          theirattentionisdrawntotheletterfromPublicRightsofWaywhich contains generalInformativeson worksadjacent toand/oron aPublic RightofWay.The gatewhich is tobe installedinthefencelineadjoining PROWHB84mustswinginwardsintothe schoolsiteandnotoutwardsonto the PROW; and

 

(iii)         KentCountyCouncilHighwayandTransportationstatethatitistheresponsibilityof theapplicanttoensure thatbefore thedevelopmentiscommenced,all necessary highwayapprovalsandconsentswhererequiredare obtained,and that the limitsof the highwayboundaryare clearlyestablishedinordertoavoidanyenforcementaction beingtaken bythe Highway Authority.  Acrossthe countythereare piecesofland next to privatehomesandgardensthatdo notlooklikeroadsorpavementsbutare actually partoftheroad.Thisiscalledhighwayland.Someofthislandisowned by KCCandsome isownedby third party owners. Irrespectiveoftheownership,thislandmayhavehighwayrights’overthetopsoil. The applicantmustensurethatthedetailsshownon theapprovedplansagreein everyaspectwiththoseapprovedundersuch legislationandcommonlaw.Itis thereforeimportant for theapplicanttocontactKCCHighwaysandTransportationto progressthisaspectof the worksprior to commencement on site.
