Proposal 18/504729/COUNTY (KCC/MA/0457/2018) - Section 73 application to vary Conditions 2 (approved plans), 3 (external materials) and 7 (access and parking) of Permission MA/16/507143 at The Lenham School , Ham Lane, Lenham; KCC Infrastructure Division

Minutes:

(1)       Mrs S Prendergast was present for this item pursuant to Committee Procedure Rule 2.27 and spoke. 

 

(2)       Mr Alastair Walmsley (Lenham PC) addressed the Committee in opposition to the proposal.  Mr Chris Foreman (Head Teacher – Lenham School) and a representative from Gen2 spoke in reply. 

 

(3)       The Head of Planning Applications Group informed the Committee that the applicants had agreed that the disused tennis courts would be made available for overflow parking during the construction period.

 

(4)       RESOLVED that:-

 

(a)          approval be given to theSection73 applicationfor the variation of Conditions2, 3 and7 subject to the conditionspreviously setoutin Permission16/507143and the additional condition requested byHighwaysand Transportation for the developmentto becommenced no laterthan 28November2021; thedevelopmentbeing carriedoutandcompletedinallrespects strictly in accordance with the submitted details,documents and plans which amend the detailsapproved underPermission MA/16/507143;  thedevelopmentbeing carriedoutusingtheexternalmaterialsas detailedwithin the submitteddocumentsandplanswhichamend the detailsapproved in Permission  MA/16/507143;  hoursof workingduringconstruction and demolition being restricted to between 0800 and 1800 on Mondaysto Fridaysand between the hoursof 0900 and 1300 on Saturdays, with nooperationson Sundaysand BankHolidays; the submissionof aConstructionManagementPlantobe approvedinwritingpriorto the commencementof development; the submissionof asurfacewaterdrainageschemetopreventdischargeof surface water  onto  the  highway prior  to  the  commencement  of  development,  and  its approval in writing; the disusedtenniscourttothewestof thenew science blockbeing made available for overspill parkingand thereafter keptavailable for such use;  theareas shownforparkingandoverflow parkingbeing providedwithin12 weeksof the occupation of thenewbuilding; theprovisionof theareas shownon the approvedplansforvehicleloading/unloading,andturningfacilitiesbeingprovided priortothedevelopmentbeingoccupied,and keptavailable thereafter; thesubmissionof asurfacewater drainagestrategyrelatingtofloodrisk,detailsof themaintenanceandmanagement ofthedrainageschemepriortothecommencementof development,with no surface water drainage into the ground occurring withoutthe expresswritten consentof the County Planning Authority;  the submission of details of thelocationof batboxes,birdboxes and the sparrowterrace priortooccupation of the site; and theapplicantsecuringandimplementing archaeological fieldevaluation works priortocommencementof the development, in accordance witha written specificationand timetable agreed in writingby the County Planning Authority; and

 

(b)         the applicant be advised by Informative of:-

 

(i)            advice regardinginfiltration drainage systemssuch as soakaways;

 

(ii)          Environment Agency’s advice that thereshould be nodischarge into land previously identified as contaminatedor made”ground,andthatinfiltrationsystemswillnotbe supported thatenablepollutantstocreatenew pathwaysintogroundwater,or mobilise contaminantsalreadyin the ground;

 

(iii)         Waste Management legislation regarding the handling,transport, treatmentand disposal ofcontaminatedsoil; and that

 

(iv)         precautionstoavoiddischargesor spillsof oil,fuelor chemicalsintotheground must be taken;

 

(v)          allnecessaryhighwayapprovalsandconsentswhererequiredmust be obtainedin orderto avoid anyenforcementaction beingtaken bythe HighwayAuthority; and

 

(vi)         TheLenhamSchoolis requested toensurethatallClubsusingthe school siteout ofhoursask theirmemberstoutiliseall on-siteparkingspacesbeforeparkingon the surroundingroads.
