Application TM/20/62 (KCC/TM/0284/2019) - Development of a Household Waste Recycling Centre (HWRC), new access to a highway, associated infrastructure and earthworks at Allington Integrated Waste Management Facility, Laverstock Road, Allington, Maidstone; FCC Environment (UK) Ltd

Minutes:

(1)       The Head of Planning Applications Group referred to a petition signed by 174 local residents in opposition to the application.  This supplemented the 376 signatories who had signed the online petition referred to in paragraph 69 of the report. 

 

(2)       Mr R H Bird was present for this item as the Local Member and spoke. He informed the Committee that his contribution had been jointly agreed with his fellow Ward Member, Mr D S Daley.   

 

(3)       The Clerk to the meeting read out representations from Mr Neil Hammond (a local resident) and the response on behalf of the applicants from Mr David Molland (FCC Environment (UK) Ltd).

 

(4)       On being put to the vote, the recommendation of the Head of Planning Applications Group were unanimously agreed.

 

(5)       RESOLVED that:-

(a)       permission be granted to the application subject to conditions, including conditions covering  covering the implementation of the permission within 3 years; the submission for approval of a ConstructionManagement Plancoveringtherouting ofconstruction anddeliveryvehicles to/ fromsite,parkingandturningareas for constructionand deliveryvehiclesandsite personnel,timingof deliveries, provisionof wheelwashingfacilitiesand temporarytrafficmanagement / signage); highway  condition  surveys being undertaken before  and  after  construction. withthe repair ofanydamage causedbyvehiclesrelatedto thedevelopment being funded by the applicants; the provisionof constructionvehicleloading/ unloadingand turningfacilities, parking  facilities  for  site  personnel  and  visitors  and  wheel  washing facilitiespriorto commencement ofwork onsiteand forthedurationof construction; the provisionof measuresto preventthe discharge ofsurfacewater ontothe highway; the provisionand permanentretentionofthe vehicleparkingspacesand /or garages,the vehicleloading/unloadingandturningfacilitiesandthe cycle parkingfacilitiesshown onthe submittedplans priorto theuseof thesite commencing; use ofa boundsurfacefor thefirst 5metres ofthe accessfromthe edge ofthe highway; completionand maintenanceof  theaccessshownon  thesubmitted planspriorto theuseof thesitecommencing; the provisionandmaintenanceof 2.4metreby43 metrevisibilitysplaysat the access,with noobstructions over0.6metres abovecarriagewaylevel within thesplays,prior touseof thesite commencing; implementation  of  the  proposed  measures  to  avoid  queuing  at  the AllingtonIWMF onLaverstokeRoad (withprovisionfor annualreviews andamended measuresbeingagreedwith KCCas necessary); hoursof use(i.e. toallowthe HWRCto beopento thepublic) being  between 0700and 2000hours on weekdays, weekendsandon BankHolidays(but closedon Christmas Day,BoxingDay andNew YearsDay) withsite maintenance/ cleaningand otheroperational activitiesbeing allowedduring the30 minutes beforethe siteopens and30 minutes afterthe sitehas closedto thepublic; the submission for approval of a ConstructionEnvironmentalManagementPlan (CEMP); Enablingand Constructionworksonlytakingplacebetween 0700and 1800 onweekdaysand Saturdaysunlessotherwiseapprovedinthe CEMP; the submission for approval of an operationalDust ManagementPlan(DMP); the submission for approval of asiteOdour ManagementPlan(OMP); no occupation of any part of the development taking place until a verification report demonstrating the completion of works set out in the approved remediation strategy and the effectiveness of the remediation has been submitted to and approved in writing by KCC; developmentworksceasingif contaminationnot previouslyidentified is foundtobepresentat thesiteuntila furtherremediationstrategyhas beensubmittedto andapprovedin writingby KCC;  no pilingorany otherfoundationdesignsusingpenetrativemethods taking place unlessapprovedin writingby KCC; theimplementationof adetailedplantingplan; treeprotectionmeasures; the removalofpermitteddevelopmentrights; avoidanceoftreeremovalduring thebird nestingseason; allplanting, seedingor turfingbeing carriedout inthe firstavailable plantingandseedingseasonfollowingthe occupation ofthe siteor the completionof thedevelopment(whicheveristhesooner); anaftercareperiodof nolessthanfiveyears; theuseof adark colouredroofingmaterial; adetailed lightingscheme; detailsof fouland surfacewater seweragedisposal; the submission for approval of adetailed sustainablesurfacewater drainagescheme anda verification report; theimplementationof ecologicalcompensationmeasures(an Ecological DesignStrategy); and post-developmentmanagementfor theecologicalfeatures(a Landscape andEcologicalManagementPlan); and

 

 

(b)    the applicants be advised by Informative:-

 

(i)           that they need to ensure that  all  necessary  highway  approvals  and consentsareobtained;

 

(ii)          that if pilingis proposed, a  Piling Risk Assessment   must   be   submitted   to   the   Environment   Agency   in accordancewith theEnvironmentAgencyguidancedocumentPiling and Penetrative GroundImprovementMethodson LandAffectedby Contamination:Guidance onPollutionPrevention.NationalGroundwater &ContaminatedLand CentrereportNC/99/73;

 

(iii)         of the needfor aTradeEffluentdischarge licenceand foran applicationto bemade toSouthernWater toconnect to thepublicfoul andsurfacewatersewer; and

 

(iv)        of  their  obligations  under  the  Wildlife  and CountrysideAct 1981inrespectof nestingbirds.
