    Application SW/20/500291 (KCC/SW/0008/2020 - Construction and operation of an Incinerator Bottom Ash (IBA) recycling facility at Plot 6B, Ridham Dock Estate, Iwade; Fortis IBA Ltd

    Minutes:

    (1)       The Head of Planning Applications presented a revision to her recommendations whereby they would not be subject to any late objections by Natural England to the application or to KCC’s Habitat Regulations Assessment  which were incapable of being satisfactorily resolved by the Head of Planning Applications following the meeting. This was agreed.

     

    (2)       In unanimously agreeing the revised recommendations, the Committee included an additional Informative encouraging the use of waterborne transportation wherever possible. 

     

    (3)       RESOLVED that:-

     

    (a)          permission be granted to the application subject to conditions, including conditions covering thepriorapprovaland implementationof aConstructionEnvironmental ManagementPlan (CEMP)to addresspotential adverseimpactsduring the constructionphase(includingthose relatingtohighways,noiseand air quality/ dust); aTravelPlan(to promoteHGV movementsoutsidethe peakperiods);  no HGVsassociatedwiththe deliveryof Incinerator Bottom Ash Aggregate (IBA)to thesiteenteringor leaving thesiteon weekdaysbetween0730 and0930 hoursand between 1630and 1830hoursotherthan fromthe KemsleySustainable Energy Plant (SEP); no more than6 HGVsassociatedwith thedelivery ofIBA Aggregate (IBAA) ormetalsfrom the siteentering orleavingthe site(i.e.6 in/ 6 out)on weekdays between0700 and0930hoursand nonebetween 1630and 18:30 hours (excludingthose takingIBAA toRidhamDockfor exportby barge); allHGVsentering andleaving thesiteviathe WesternAccessRoute priorto thecompletionand openingof theGrovehurstJunction improvementsunless deliveringIBA tothesitefrom theKemsleySEP; nomore than310,000 tonnesof IBAAand metalsbeing exportedby road fromthesitein any12 monthperiod; no morethan 165,500tonnes ofIBA beingimported tothesiteby road fromsourcesotherthan theKemsley SEPin any12 monthperiod; recordsbeingkeptandmadeavailableto KCCto demonstrate compliancewith theaboverestrictions; thesurfacingof the siteaccessbeingmaintained ina goodstate ofrepair andkept cleanandfree ofmud andother materialsat alltimes; measuresbeing takentoensurethat vehiclesleavingthe sitedo not depositmud orothermaterials onthe publichighway(includingby useof wheel andchassiscleaning equipmentas necessary); allloaded,openbackedvehiclesentering orleaving thesitebeing properly enclosedor sheeted; measuresto minimiseair quality(includingdust)impact; nopiling worksbetween Novemberand February(inclusive)(or piling worksonly beingcarried out between themonthsof Marchto October(to avoidthe corewinterperiodof Novemberto February)),if pilingis necessaryatall; lightingbeing installed,usedand maintainedin accordancewith the applicantslighting designstrategy toavoidlightspillageonto adjoining areasto ensurethat anylightspillagedoesnot exceed0.5 Lux; theremovalof permitteddevelopmentrightsto ensurethatno additional buildings,plantor machineryare erectedor installedon siteunless approvedbeforehandby KCC; thepriorapprovalby KCCof allancillarybuildings; theremovalof all IBA,IBAA, metalsorother materials,buildings,plant and machineryfrom thesite within2 yearsof thepermanent cessationof the IBARecyclingFacility; theoperationallayoutof thesitebeing asproposed; stockpileheightsof IBAand IBAAbeing restrictedto nomore than10m; theprocessingplantbeing colouredandmaintained inlightgrey; theimplementationof a remediationstrategy in thescenarioin whichunexpectedcontaminationis encounteredduring developmentof thesite; no surface,processor foulwater beingdischargedfrom thesite; and afloodevacuationplan;and

     

    (b)          the applicants be advised by Informativethat:-

     

    (i)           for thepurposes ofthe highwayrestrictions whichrefertothe Kemsley Sustainable Energy Plant (SEP),this shallbetaken tobe theconsented K3SEP andany permissionsthatmaybe grantedfor theK3 SEP expansionand Wheelabrator Kemsley North (WKN)viathecurrentDCOprocess;

     

    (ii)          the TravelPlan mustincludesufficient detailregardinghow it willbeimplementedand itseffectiveness monitoredand containdetailsof themechanismsto beusedto review thePlanand introduceamended and/ ornewactionsto achievethe statedintentionsif monitoringsuggestsits intentionsare notbeing achieved;

     

    (iii)         in accordancewith GovernmentGuidance, detailedcontrolsin respectof emissionswillbematters forthe EnvironmentAgencyunder thetermsof theEnvironmentalPermit and thatany newdevelopmentat thesiteand /or changesin operational proceduresmust bein accordancewith the EnvironmentalPermit; and

     

    (iv)         they are encouraged to use waterborne transport wherever possible.
