In the DFE free school meals guidance under EOTAS, it details
the councils need to "act in accordance with Human Rights Act,
European Convention on Human Rights and to COMPLY with the public
sector equality duties". Yet KCC are still refusing to provide Free
School Meals to those who meet the criteria to receive FSM due to
their children attending school. Therefore is creating a
disadvantage to the families in receipt of EOTAS, the purpose of
EOTAS is due to their child's disability, school is deemed
inappropriate so therefore this is discrimination.
KCC you are clinging onto the understanding that there is no
mandatory to provide FSM to 'all', yet ignorance to it being an
entitlement benefit so it goes against the equality act to deny
those who would be entitled in school. Therefore KCC needs training
surrounding the Equality Act as policies do not align.
