Local Planning Authorities are granted a power under the Town and Country Planning Act 1990 to stop up or divert public footpaths, bridleways and restricted byways when they are affected by authorised outline or detailed development. In most instances within Kent the local planning authority is the District or Borough Council.
Kent County Council Countryside Access service has entered into Service Level Agreement with Ashford Borough Council to carry out the necessary procedures on their behalf on all Public Path Orders under the Town and Country Planning Act 1990.
There is no statutory costs for carrying out this service, therefore the County Council must set its own costs, as outlined in the Cost Schedule
Although, at present, this relates to work undertaken on behalf of Ashford Borough Council there is a possibility that should this prove successful then it may be offered to other Borough and District Council. The same costs as outlined in the Cost Schedule would then apply.
